After clerking for Justice Bertha Wilson at the Supreme Court of Canada, I practiced for six years at a boutique law firm in Vancouver that specialized in complex litigation. From the outset, I was assigned to a litigation team that was advancing a major piece of Indigenous litigation through the Courts. In 1996 I founded Donovan & Company – a firm dedicated to advancing justice and prosperity for First Nations through assisting with long term planning, governance issues, business development, assertion of Aboriginal rights and title, specific claims resolution, negotiations with business and government and litigation. I have had the privilege of seeing the firm develop into a strong player in the Aboriginal law area with a growing, passionate and dedicated team.

It has been an enormous and humbling privilege for me to work closely with determined and visionary First Nations leadership. Listening carefully to the vision and goals of the First Nation is always central. Planning and continued review of strategic options follows. Not every problem has a legal solution but more often than not there are legal aspects to both the challenges facing First Nations and the opportunities open to them.

When I am not working on Indigenous legal issues I can often be found out running, hiking and enjoying nature, talking to the bees and chickens, and working with my wife Mona on our continued efforts to assist small communities in Southwestern Nicaragua.

“Today, CBC Aboriginal will be renamed CBC ‘Indigenous’ {But Canadian aboriginals aren't 'Indigenous' to Canada}, and CBC's Aboriginal Digital Unit will become the ‘Indigenous’ {sic} Digital Unit. While we understand that there is no truly all-encompassing term, ‘Indigenous’ is fast becoming the preferred way to refer to ‘First Nations’ {Another recently-invented term for Indian Bands}, Inuit and Métis {mixed Race} peoples.
{Only because it is being promoted by the politicized Aboriginal Industry – of which CBC is a major component -- and the reality is that applying the term to Canadian aboriginals is a well-known falsehood...}
“In adopting this change, we join the ranks of many individuals, groups, organizations, universities and governments — both nationally and globally — who have chosen to {incorrectly} use the term ‘Indigenous’.
“In 1982, the Canadian government adopted the legal term "Aboriginal peoples of Canada" in the Constitution Act, referring to the Indian, Inuit and Métis peoples of Canada. said University of Manitoba Prof. {and Aboriginal Industry activist} Niigaanwewidam Sinclair {whose career has been propelled by the privilege that accompanies the son of a prominent member of the parasitic aboriginal elite}.
“This was affirmed In May 2016, when the {so-called ‘Conservative’} federal government officially {and foolishly} adopted the UN Declaration on Rights of Indigenous Peoples.

“Our change to ‘Indigenous’ {sic} comes after consulting with {hired on the basis of Race} ‘Indigenous’ CBC staff from across the country. END RACE BASED LAW Radio-2 "The Petition" explained by Gerry Gagnon with Michele Tittler

PETITION TO THE HOUSE OF COMMONS:

WE, the undersigned citizens of Canada, draw the attention of the Government of Canada to the following:

THAT whereas the Indian Act and Section 91(24) of the Constitution Act, (1867) have divided Canadians by race and heritage; have perpetuated the unequal treatment of Canadian Indians, providing the legal framework for segregation via the reserve system; have prevented reserve Indians from equal provincial educational access; have prevented reserve Indians from having the full legal, economic and property rights and opportunities of other Canadian citizens;

AND whereas the inclusion of Sections 35 and 25 in the Constitution Act (1982) have divided Canadians by race and heritage; have disrupted legal commercial and exploration activities; have introduced legal uncertainty into property ownership; have left some Canadians without proper police protection, as in Caledonia, Ont.; and have left most Canadians with diminished rights with every expansion of 'indigenous rights' based on Section 35;

AND whereas the inclusion of "with particular attention to the circumstances of aboriginal offenders" in Section 718.2(e) of the Criminal Code (R.S.C., 1985, c. C-46) has resulted in a two- tiered system of justice, wherein Canadians receive different legal outcomes, depending on their race/ethnic heritage;

AND whereas the United Nations "Declaration on the Rights of Indigenous Peoples" contains provisions that are fundamentally incompatible with Canada's constitutional framework;

THEREFORE, your Petitioners call upon the Government of Canada to take the following actions:

THE passage of the repeal of the Indian Act;

THE passage of the removal of "with particular attention to the circumstances of aboriginal
offenders" in Section 718.2(e) of the Criminal Code (R.S.C., 1985, c. C-46);

THE removal of Canada's signature from the United Nations "Declaration on the Rights of
Indigenous Peoples";

THE calling of a Constitutional conference, pursuant to Section 35.1 of the Constitution Amendment Proclamation (1983), leading to the repeal of Sections 35 and 25 of the Constitution Act (1982), and Section 91(24) of the Constitution Act (1867);

THE active encouragement of the provincial legislatures to do the same, or via provincial referenda; and the calling of a federal/provincial Constitutional conference to finalize these changes desired by the people of Canada, including setting a date for the final termination of Treaty and land claims submissions.

Justice Murray Sinclair and his outrageous "Truth and Reconciliation Commission Recommendations" have to stop bullying and blaming Canada and innocent tax payers. It's enough now! It was just school, the same school system we all went to, and there were many more good stories than bad, but the "Indian Industry" of lawyers, lobbyists and Chiefs have turned it into the massive racist blame game it's grown into today, by systemically ignoring any and all good, and extorting and bullying for whatever bad can be found, preyed upon, exaggerated, lied about, and used to bash Canada and innocent tax payers. None of it's been about helping the individuals who had some negative experiences, it's all been about one blanketed blame game, indicting everyone who is not their race, creating perpetual victims out of everyone who is. It's out of control, and people are dying from their constant focus on nothing but blame, and never accountability.
